Contractor Agreement Definition
Under a lump sum contract, the contractor and contractor agree, before the work begins, a “fixed price” for the work to be carried out. This contract may also apply to housing and industry contracts. It may be a greater risk to the contractor because there are fewer mechanisms that allow the contractor to vary its price. An agreement is an agreement between two or more parties. A contract is a particular type of agreement which, by its terms and elements, is legally binding and enforceable in court. The owner exercises governance through the contractor. The contractor exercises governance through internal units and subcontractors. Practical completion is carried out when the contractor returns ownership of the site to the owner, usually at the time the work has been completed and accepted by the client. As a general rule, half of the deductions are released, the contractor`s eventual liability for the liquidated damages ends and the period of correction of the defects begins.  The main advantage of an agreement that does not meet the criteria of a contract is that it is by nature informal. If contractors have a long-standing relationship and share a considerable degree of trust, the application of a contract can save time and flexibility in fulfilling agreed commitments.
Agreements that do not contain all the necessary elements of the contract may also be more feasible in situations where contracting would impose a prohibitive burden on the parties concerned. In the lump sum contract, all work is carried out according to plan and specifications by the contractor for a specified fixed amount, in accordance with the agreement. The owner provides the necessary information and the contractor calculates a certain amount. This contract is appropriate if the number of items is limited or if it is possible to develop exact amounts of work to be done. Detailed specifications of all work points, detailed plans and drawings, deposit, penalty, progress and other contractual conditions are included in the Convention. Although it is a lump sum and a planned contract, the contractor is paid at regular intervals of 2 to 3 months after demsol work on the basis of a certificate issued by the competent engineer. A planned price is included in the agreement for the payment of additional items. An agreement is a far-reaching approach that involves any agreement or agreement between two or more parties on their rights and obligations. Such informal agreements often take the form of “gentlemen`s agreements”, in which compliance with the terms of the agreement is based on the honour of the parties concerned and not on external means of implementation.
